These Terms of Service ("Terms") govern your access to and use of REM ("Service"), operated by Oliver Luevano Zarate. By using the Service, you agree to be bound by these Terms.

1. Service Description

REM is an AI-powered assistant platform that integrates with messaging channels including WhatsApp, Messenger, and Instagram to automate customer communications for businesses.

2. Account Registration

To use the Service, you must:

• Be at least 18 years old or have legal capacity to enter contracts
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or unauthorized commercial communications
• Engage in fraud, deception, or impersonation
• Violate any applicable law or regulation
• Infringe on intellectual property rights
• Distribute malware or harmful code
• Harass, threaten, or harm others
• Attempt to reverse engineer, decompile, or extract source code
• Use the Service to violate Meta's Platform Terms or any third-party platform terms

4. Compliance with Third-Party Platforms

When using REM with WhatsApp, Messenger, or Instagram, you must comply with all applicable Meta platform policies, including but not limited to messaging policies, commerce policies, and community standards. Violations may result in suspension by Meta and termination of your REM account.

5. Customer Data and Privacy

You are responsible for:

• Obtaining proper consent from your customers before initiating communications
• Complying with all applicable data protection and privacy laws
• Providing your customers with appropriate privacy notices
• Ensuring lawful basis for processing customer data through our Service

6. Subscription and Payment

Access to certain features may require a paid subscription. Pricing and payment terms will be presented at the time of purchase. Subscriptions renew automatically unless cancelled. Refunds are handled on a case-by-case basis.

7. Intellectual Property

The Service, including all software, designs, and content, is owned by REM and protected by intellectual property laws. You retain ownership of the content and data you provide to the Service. You grant us a license to use this data solely to operate and improve the Service.

8. AI-Generated Content

The Service uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may occasionally be incorrect, incomplete, or inappropriate. You are responsible for reviewing and approving the deployment of REM in your business, and for any consequences of AI-generated communications.

9. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or factors beyond our control.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REM AND ITS OPERATOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless REM and its operator from any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your communications with third parties through the Service.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason, with or without notice. You may terminate your account at any time by contacting support@try-rem.com.

14. Modifications

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Mexico. Any disputes shall be resolved in the competent courts of Monterrey, Nuevo León, Mexico.
